The brand of cigars known as Guantanamera is manufactured by two different companies though the brand name is same. The name of the first company is Guantanamera Cigar and the factory is located in Miami in the state of Florida. The factory of the second company is located in Havana in Cuba and is known as Habanos SA which is owned by the state.
The Guantanamera brand of cigars was a comparatively new entrant into the cigar market when it was introduced in the year 2002 and has already become popular because of its low price. The Guantanamera brand of cigars probably got its name from a famous Spanish song titled “Guajira Guantanamera” sung in the evenings at the bars in Cuba depicting a peasant girl’s exploits.

The company called Guantanamera Cigar based in Miami had been defending its right to use the name of Guantanamera as a brand name against the Cuban company named Habanos SA of Cuba since 2002 and has recently submitted an appeal at an US Court in the Columbian District to uphold its right.
Since the name of the brand carries a Cuban name which depicts a girl from the Guantanamo area in Cuba, Habanos SA had submitted an argument that the name can be used only by it and nobody else outside Cuba. It argued that the company named Guantanamera Cigar is deceiving the customers regarding the geographical location of the manufacturer as it is not based in Cuba but in Miami in the United States.
On the other hand the company called Guantanamera Cigars says that the name of the brand has been taken from an international song and the consumers in America are fully aware of the geographical area called Guantanamo which has become quite famous in the past few years.
The Board for trials and appeals on trademarks gave its ruling in favour of Habanos SA in 2008. Immediately afterwards, an appeal was filed by the company called Guantanamera Cigars, at the District Court in Columbia in the US against the ruling given in favour of Habanos SA which is a foreign company.
The company called Guantanamera Cigars also filed a suit against the company called Habanos SA in District Court in South Florida for inserting an advertisement in magazine that dealt with the distribution and sales of cigars in America. When the case was dismissed by the court in South Florida, an appeal was made to the District Court in Columbia against the dismissal. This court also dismissed the appeal made regarding the infringement of the rights of use, as an advertisement does not specify usage as per the Act promulgated by Lanham.
The District Court in Columbia upheld the motion made by the company based in Miami called Guantanamera Cigars on 5th of August in 2010, and gave a ruling that the trial and appeals board for resolving disputes on trademarks had made an error while pronouncing the judgement in favour of Habanos SA.
The dispute over the use of the name of Guantanamera as a brand name is still going on with more trials and appeals to come in the future.
